What Is the EB-2 NIW Visa?

The EB-2 NIW (National Interest Waiver) visa is an employment-based immigrant visa category that allows professionals holding advanced degrees or of exceptional ability to obtain permanent residence in the United States without a job offer or PERM labor certification.

The “national interest waiver” means that the beneficiary can show that their work substantially benefits the United States, which justifies waiving the usual requirement of having a sponsoring employer. Learn about our firm’s EB-2 NIW service.

Main advantage: Complete freedom to work in any field related to your area of expertise, without being tied to a specific employer.

The 3 Prongs of Matter of Dhanasar

In 2016, USCIS established a new legal framework for evaluating EB-2 NIW petitions. You must demonstrate all three of the following elements:

  1. The Proposed Endeavor Has Substantial Merit and National Importance

Your work must have significant value and broad impact. This includes:

    • Scientific or technological advances
    • Improvements in public health or education
    • Economic or cultural benefits
    • Business innovation that creates jobs
  2. You Are Well Positioned to Advance the Proposed Endeavor

You must show that you have the education, skills, knowledge, and record of success needed to carry out your proposal. Evidence includes:

    • Advanced degrees (master’s degrees, doctorates)
    • Publications, patents, or research
    • Recommendation letters from experts
    • A track record of achievement in the field
  3. On Balance, It Would Be Beneficial to the United States to Waive the Job Offer Requirement

You must show that the benefits of your work outweigh the interests of the U.S. labor market. Considerations:

    • The urgency of the problem you are solving
    • A shortage of qualified U.S. workers in your field
    • The impracticality of obtaining a labor certification
    • Immediate or future national benefit

Education and Experience Requirements

To qualify for EB-2, you must meet ONE of the following requirements:

Advanced Degree

  • A master’s degree, doctorate, or foreign equivalent
  • A bachelor’s degree + 5 years of progressive post-baccalaureate experience

Exceptional Ability

Meet at least 3 of the following:

  • An official professional license or certification
  • 10+ years of experience
  • Membership in professional associations
  • Recognition for achievements
  • A significantly higher salary

Frequently Asked Questions

Frequently asked questions about EB-2 NIW: requirements, cost, timelines and process

What is the EB-2 NIW and how is it different from a regular EB-2?
The EB-2 NIW (National Interest Waiver) is a subcategory of the employment-based EB-2 immigrant visa. Unlike the traditional EB-2 —which requires a job offer and labor certification (PERM)— the NIW waives those requirements because the applicant's work is in the U.S. national interest. The result: you can obtain a Green Card with no employer or sponsor.
Who qualifies for the EB-2 NIW?
You must meet the EB-2 threshold —an advanced degree (master's or higher), or a bachelor's plus 5 years of progressive experience, or demonstrable exceptional ability— and also satisfy the three Matter of Dhanasar prongs. It fits professionals, researchers, entrepreneurs, physicians, engineers and people with a strong record in their field.
What are the 3 Matter of Dhanasar prongs?
(1) Substantial merit and national importance: your work has real value and significance to the U.S. (2) Well positioned to advance it: your education, record, plan and achievements show you can deliver. (3) Favorable balance: on the whole, it benefits the U.S. to waive the job-offer and PERM requirements. All three must be shown with evidence.
Do I need an employer or a job offer?
No. The EB-2 NIW's biggest advantage is that it requires no job offer, employer or labor certification. You file the petition yourself (self-petition), giving you freedom to change jobs, start a business or work independently after getting your Green Card.
What evidence makes a strong EB-2 NIW petition?
Degrees and certifications; recommendation letters from independent experts; publications, citations and patents; awards and recognition; evidence of impact (media, adoption of your work, contracts, funding); a clear endeavor statement; and documentation of your field's merit and national importance. The quality and coherence of the evidence is decisive.
How much does the EB-2 NIW cost?
USCIS fees for Form I-140 are about $715 USD. Premium Processing (a decision in ~45 days) is optional and costs an additional $2,965 USD. If you adjust status inside the U.S., Form I-485 has separate fees. Legal fees are on top of this. A case evaluation gives you the exact cost for your situation.
How long does the EB-2 NIW process take?
The I-140 takes 6 to 12 months (or ~45 days with Premium Processing). After that it depends on your priority date and the Visa Bulletin by country: for most countries the Green Card step moves relatively quickly, but for those born in India or China there can be a multi-year wait due to quotas.
EB-2 NIW or EB-1A — which is right for me?
EB-1A (extraordinary ability) has a higher bar but often more favorable priority dates and requires no degree. EB-2 NIW has a more attainable standard (merit + national importance) and is ideal for strong professionals who don't reach the "extraordinary" level. Many strong profiles qualify for both; an evaluation helps pick the best strategy.
Can I include my family?
Yes. Your spouse and unmarried children under 21 can get residence as derivatives of your petition. If you adjust status inside the U.S., your spouse can apply for a work permit (EAD) while the case is pending.
What happens if USCIS issues an RFE (Request for Evidence)?
An RFE asks for additional evidence; it is not a denial. It is common and is answered within the stated deadline (usually up to ~87 days) with documentation that strengthens the questioned points. A well-prepared response from your attorney typically resolves the case favorably.
Can I apply for the EB-2 NIW from outside the United States?
Yes. If you are outside the U.S., the case is completed through consular processing at your country's embassy/consulate after the I-140 is approved. If you are already lawfully inside the U.S., you can adjust status (I-485) once your priority date is current.
